Contrary to certain claims made by Opposition Ruled States, Particularly a recent claim by Gujarat Chief Minister Shri Narendra Modi who has opined that his state opposed the GST (Goods and Services Tax) initiated by the Ministry Of Finance, Government Of India because it needs an IT Infrastructure/Strategy in place. The Government Of India clarifies that the IT Infrastructure Plan for GST was already in place on July 21, 2010.
The broad IT plan for enabling GST was presented to the Government of India and the Empowered Committee of State Finance Ministers under the Chairmanship of Dr. Asim Dasgupta on July 21, 2010. This document is a follow-up to that presentation and feedback thereon and describes the IT strategy for GST implementation.
GST can only be implemented when All the States in India agree on a common consensus to implement it.
The merits of GST
GST will bring about a change in the tax system by redistributing the burden of taxation
equitably between manufacturing and services. GST will enable broadening of the tax base,
which will further result in reduction in effective rate of tax. It will reduce distortions by applying
the destination principle for levy of taxes. It will foster a common market across the country,
reduce compliance costs and promote exports. It can provide a fiscal base for local bodies to
enable them to fulfill their obligations. It will facilitate investment decisions being made on purely
economic concerns independent of tax considerations.

Mahatma Gandhi NREGA Wage Rates Hiked by 17-30 Percent -
In pursuance of its commitment towards the welfare of the rural poor , the Government has enhanced the wages under Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA). This will result in 17-30% enhancement of wages under the premier flagship program of the Government across the country. The move is likely to benefit more than 5 crore beneficiaries under MGNREGA across the country. The wage rates have been hiked on the basis of Consumer Price Index for the agricultural labour calculated on the basis of Rs. 100 or the actual wage rate, whichever is higher as on April 1st, 2009. As per the amended notification issued by the Ministry Of Rural Development the new MGNREGA wage rates will come into effect from January 1, 2011 or the date of actual payment of the revised rate, whichever is later.
In fact the new wage rates are higher than the prevailing wages rates under MGNREGA at present in many states as follows :

The decision to hike wages under MGNREGA comes in the wake of recommendations of National Advisory Council and consultations with the different Ministries. Linking the wages to Consumer Price Index for the agricultural labour will result in annual revision of the wage rates. Meanwhile, the Government is also waiting for the report of the Pranob Sen Committee constituted to deliberate upon a separate index for MGNREGA. The recommendations once submitted by this Committee will also be considered by the Government. Under MGNREGA in the financial year 2010-11, upto December, 4.10 crore households have been provided employment and 145 crore persondays have been generated. The average wage earned has risen from Rs 65 per person day in 2006 to Rs 100 by 2011. Women constitute 50% while Scheduled Castes account for 23 %, and Scheduled tribes comprise 17% of those working in Mahatma Gandhi NREGA in 2010-11. Over 10 crore accounts of Mahatma Gandhi NREGA beneficiaries were opened in post offices/banks contributing to financial inclusion. Among the works taken up under MGNREGA, water conservation, irrigation and land development account for over 75% of work taken up in 2010-11 till Dec.2010.
The decision to hike wages under Mahatma Gandhi NREGA is a reflection of the Government’s commitment to provide adequate livelihood security to the poor, down trodden, and members of Scheduled Castes and Scheduled Tribes. This hike will go a long way towards meeting the requirements of the needy in the rural areas en route to achieve the goal of inclusive growth and development across the country.
Monitoring Mahatma Gandhi NREGA
A total of 1327 complaints up to 31.3.2010 and 492 complaints during the current year, (up to 11.2.2011) regarding irregularities of all types in the implementation of Mahatma Gandhi NREGA have been received in the Ministry of Rural Development. Since the act is implemented by the State Governments in accordance with the Schemes formulated by them as per the provisions of the Act, all complaints received in the Ministry are forwarded to the concerned States for taking appropriate action as per law. In complaints of serious nature, the Ministry deputes National Level Monitors to investigate the complaints. Reports of the NLMs are shared with the concerned State Governments for taking corrective action. Following measures have been undertaken to monitor the implementation of the Mahatma Gandhi NREGA :
(i) ICT based MIS has been made operational to make data available to public scrutiny including Job cards, Muster rolls, Employment demanded and allocated, number of days worked, shelf of works, Funds available/spent and funds released to various implementing agencies, Social Audit findings, registering grievances and generating alerts for corrective action.
(ii) Payment of wages to MGNREGA workers has been made mandatory through their accounts in Banks/Post Office to infuse transparency in wage disbursement.
(iii) Rolling out Biometric based ICT enabled real time transactions of MGNREGA workers to eliminate fake attendance and false payments.
(iv) Periodic reviews in the Performance Review Committee meetings held on quarterly basis. State specific reviews are also undertaken
(v) Independent Monitoring and verification by National Level Monitors and Eminent Citizens.
(vi) Visit by members of Central Employment Guarantee Council.
(vii) State and district level Vigilance and Monitoring Committees have been set up.

National Broadband Plan- To connect 160 million homes by 2014
TRAI has sent its recommendations on “National Broadband Plan” to DoT on 08th December 2010. The salient features of the TRAI’s recommendations on National Broadband Plan are:
i) A National Broadband Network will be established, which will be an open access optical fibre network connecting all habitations with population of 500 and above.
ii) This Network will be established in two phases. The first phase covering all cities, urban areas and Gram Panchayats will be completed by the year 2012. Phase II will see the extension of the network of the network to all the habitations having a population more than 500, to be completed by the year 2013.
iii) In order to establish this broadband network, National Optical Fibre Agency (NOFA) at the national level and State Optical Fibre Agency (SOFA) at the State level would be formed. NOFA will establish the networks in all the 63 cities covered under Jawahar Lal Nehru Urban Renewal Mission (JNURM). All the SOFAs, under the overall guidance of NOFA will establish the networks and backhaul in the rural areas and in the urban areas other than those cities covered under Jawahar Lal Nehru Urban Renewal Mission (JNURM).
iv) This network which is estimated to cost about Rs.60000 crore, is proposed to be financed by USO fund and the loan given/guaranteed by Central Government.
(e) to (f) As on 31st December 2010 number of Broadband subscribers in the country is 10.92 million as compared to 752.19 million Mobile subscribers. The main reasons for slow growth of Broadband are non-availability of infrastructure to provide connectivity upto village level, non-availability of content in Vernacular Languages, low English literacy, affordability of Customer Premises Equipment and Right of Way.
Earlier Telecom minister Kapil Sibal had said that the National Broadband plan will connect 160 million Indian households with high-speed Internet connections by 2014 on 20 January, 2011 while unveiling the plan.

The Governing Board of the new Nalanda University on Monday laid down a road map to make the institution functional tentatively by 2013. The recruitment of faculty would be done one or two semesters before the first batch is enrolled so that they have a role in finalising the course structure.
The University will start with seven schools, primarily in humanities, but will include departments of Information Sciences and Technology, Business Management in Relation to Public Policy and Development and Ecology and Environment, in addition to Languages and Literature; Religion and Philosophy; Historical Studies, International Relations and Peace Studies; and Buddhist Studies.
First meeting
This was the first meeting of the Governing Board, which was earlier functioning as the Nalanda Mentor Group, and was attended by Gopa Sabharwal, who has just been appointed as the first Vice-Chancellor of the Nalanda University, to be set up just about 10 km away from the historic location of the Nalanda university in Bihar.
“We will try and enrol the students as soon as possible and as soon as infrastructure comes up at the site,'' Amartya Sen, chairperson of the Governing Board told journalists after the meeting. The meeting also discussed the statutes that would govern the University and the institutions relations with other universities. He said the focus at the beginning would be only on humanities due to the less cost involved. As we expand, we will include other subjects as well, he explained.
“In keeping with the extraordinary traditions of the historic University, we will develop the University as only as a secular institution but where religion will also be included,'' Professor Sen said clarifying that the university was an academic venture and not a diplomatic exercise just because several Asian countries had contributed for its development.
Foreign Minister of Singapore George Yeo – who is also on the Governing Board – said the entire issue of setting up the University is an “exciting exercise” and the institution would help in the over all development of the region which is backward. He also sought an international airport near Nalanda and said the Buddhist tourist circuit would get a boost once the institution became functional.
Global tenders
Announcing that the Governing Board had decided to go for global tenders, Dr. Sabharwal said 446 acres of land for the project had been acquired for the purpose. “Our aim would be to develop a state-of-the-art university,'' she explained adding that history showed that 200 villages around the old Nalanda University supported the institution and now was the time to do the reverse as the University would help in the development of these villages that would be traced and identified during the process of “interaction'' with the region.

According to Circle Inspector (Rural) Harischandra Reddy, in the suicide note Srisailam stated that he was committing suicide as he was worried that Telangana may not be formed. He was survived by wife and two children. The police registered a case and investigating."

Salient Features of the Sports Development Bill 2011
Shri Ajay Maken, Union Minister of State (independent charge) for Youth Affairs and Sports made a statement in the Lok Sabha yesterday regarding the intent of the Government to initiate a national debate on the need to have a legislation for the development of sports at the national level and to deal with all matters concerned. TheSalient features of the Sports Development Bill 2011 are:
Preamble:
1) The Bill has been formulated to celebrate the spirit of sport and fair play, imbibed the philosophy of Olympism. The Preamble of the Bill begins with this essence serving as a motivation towards drafting of the Bill.
2) The Preamble of the Bill also states that this Bill does not intend to transgress into the independence of the National Sport Federations and the National Olympic Committee. The Bill only seeks to imbibe the practice of good governance accepted around the world in the Indian scenario.
3) The Preamble has also addressed the public concern of accountability of these sport bodies. In the Preamble it has summarily stated that the Bill seeks to recognize these sports federations as bodies performing public functions. It has also sought to address the issues of sexual harassment, age fraud, impediments to Right to Information, speedy resolution of sport disputes, anti-doping, transparency and good governance.
4) The Preamble also states that this kind of legislation is of essential importance in the current scenario, since there exists a state of flux as to sports in India. But the reach and effect of sport and working of sporting federations in India is felt worldwide.
Definitions (section 2):
1) Important terms like an Athlete, Athlete Advisory Council, Applicant, Recognition, Eminent Athlete, Office Bearer, Sports Ombudsman, Sports Administrator and most importantly the crux of the legislation ‘Sports’ have been defined. A detailed enumeration of what amounts to sports has been addressed in the Second Schedule.
Provisions of the Draft Bill:
1) Chapter VII deals with essential conditions that have to be incorporated by the NSF and others in the bye laws and constitution. Broadly hey have been enumerated in Section 15 of the Bill and are retirement age for members as 70 years, inclusion of athletes in the decision making process, ensure that 25% of the membership and voting powers is held by athletes [Section 15(1)(d)] the Union Minister of Sports shall not be eligible to contest for post in NOC or NSF [Section 15(1)(g)(vi)] and restriction on the term of Office Bearers to two terms of four years each[Section 15(1)(g)(vii) and restrictions of concurrent holding of positions by Office Bearers in NSFs [Section 15(1)(g)(ix)].
2) The voice and representation of an Athlete/Sportsperson has been missing in the top echelons of sports governance in India. Under Section 4 of the Bill, an effort has been made to constitute a National Sports Development Council which is to be headed by an Eminent Athlete ( a sportsperson who has been conferred with national or international awards). It comprises of a vast representation from all facets of sports like members from the National Olympic Committee, Paralympic Committee of India, National Sports Promotion Board, Vice Chancellor of Sports University, sportspeople, sports science specialist, National Anti-Doping Authority, Sports Authority of India, Government representative, Sports law specialist, sports journalist and sport NGO’s.
3) A very important thought behind the formation of the Council under Section 4(3) is that seven members have been sought from the actual sports people playing the sport. Importantly the control of the Council has also been retained to voice the opinion of the Athletes in India with the Chairperson being an Eminent Athlete. The majority of the voting powers i.e 15 out of 23 in this Council has been retained by members who are not a part of the federations, the Government or the Sports Authority of India.
4) Under Section 6(2)(f) the NOC (National Olympic Committee, IOA in our case) has been made responsible for the conduct of the National Games every 2 years. Under Section 6(2)(g) the NOC has been obligated to hold fair and transparent election every 4 years. Additional obligations placed upon NOC are to maintain public accountability, resolve disputes through a proper mechanism of Dispute resolution within 15 days [Section 6(2)(h)], enact bye laws in compliance with IOC Charter and directions. The NOC has been obligated to notify all about its General Assembly meeting 21 days in advance [Schedule 5, part 3], besides obligations to publish the voters list and the candidate list on the website and at a prominent place in the office has also been provided[Schedule 5, Part 4 and 7]. Most importantly an obligation to record the election by Video Conferencing has been provided so that in case of questions of election dispute it can be resolved through hard evidence[Schedule 5, Part 10]</span>.
5) Chapter IX deals with Dispute resolution of Sports disputes. The Bill has sought to set up an office of a Sports Ombudsman (a retired High Court Judge with knowledge about sports law or arbitration with general knowledge of sports). It has also seeks to set up an appellate authority with a representation of a sportsperson and from the Government. All awards of the Sports Ombudsman and Appellate Authority are to be binding as Final Awards under Arbitratio and Conciliation Act 1996. Time limit of one month has been imposed on the Sports Ombudsman and the Appelate Authority to give their decision under the Bill (rule 14, Sports Ombudsman Scheme) . Additionally provisions have also been made to provide for hearings through video and teleconferencing.
6) Restrictions have been places on non-recognized NSFs under Section 8(1) to use the expression ofIndia or Indian, represent India in International federations, receive financial assistance, select athletes and depute teams, organize or conduct recognized events.
7) UnderSection 8(2)(g) the NSFs have been obligated to submit to the Government their audited accounts, measures taken to combat sexual harassment, doping, age fraud, participation of minorities and disabled. An important obligation has also been imposed to promote excellence in sports through the participation of Elite Athletes, under Section 8(2)(g)(vi)
8) Section 22 deals with the ambit of foreign nationals to represent India. It clearly states that only Indian passport holders and NRI’s can represent India. It expressly restricts PIOs and OCIs from representingIndia.
9) Section 21deals with the prevention of sexual harassment, the guidelines for which have been laid out in the 8th Schedule and is bound to be incorporated by the NOC, NSFs, SAI and all other promotional organisations.
10) The concept of one NSF for one sport discipline has been affirmed in Section 7(1).
11) Chapter VI has sought to classify NSFs based on Olympic Sports, sports included in other major competitions and popular indigenous sports.
12) Under Section 6(2)(b) the NOC has obligated to observe the principles of Olympic charter, Basic Universal Principles of Good Governance proposed by the IOC. The NOC has also been obligated under Section 6(2)(c) to take permission from the Government before bidding for any major sporting event, since vast government resources of the country are involved in the conduct of such games.
13) Chapter X deals with anti-doping and drug free sport. Section 18recognizes the establishment and functioning of National Anti-Doping Agency (NADA). Section 19 recognizes the establishment of National Anti-Doping Laboratory.
14) Section 20 deems the passing of the National Code for Prevention of Age Fraud to have been passed under this Act.
15) Section 4(3) has clearly laid out that the tenure of the members of the National Sports Development Council would be restricted to four years and that the members shall not be eligible for reappointment. This has been done to have new voices regularly to promote the development of sports in India.
16) Under Section 8(2)the NSFs have been obligated to announce their yearly calendar on or before 31 December every year. This would facilitate the athletes to manage their yearly schedule accordingly.
17) Under Section 6(2)(l)the NOC has been obligated to submit before the Parliament its audited statements, report of activities and measures taken to promote athletes welfare, combat the evil of doping, expeditious dispute resolution, compliance with Right to Information and prevent gender discrimination and harassment of women in sports.
18) Under Section 5(1)(b)(i) the development and promotion of a individual sports has been retained by the National Sports Federations.
19) Chapter IX deals with the suspension and withdrawal of recognition. It has laid down conditions like failure o submit accounts, hold elections, suspension from NOC, misuse of Government assistance, failure to abide by the conditions on which recognition has been granted and internal and serious irregularities detected by the Registrar of Societies/companies or in public interest.
20) The Council under section 4(8) has also been termed to meet everythree months to promote the objective of development of sports.
21) The recognition of the NSF underSection 5(a)(i)\ has now become subject to certain guidelines. The funding by the Government of these NSFs has also been subject to governance, performance and the priority of the sport being governed, under Section 5(1)(a)(ii)
22) Under Section 5(c)(iii) the Sports Authority of India has been entrusted with the task of evaluating the performances of the athletes and the NSFs with the Long Term Development Plan for Sports in India.
23) Chapter IV</span> deals with the provisions pertaining to the National Olympic Committee (NOC) which in the Indian scenario is the Indian Olympic Association, subject to it maintaining its recognition by the International Olympic Committee, underSection 6(2)(a)
24) Under Section 6(2)(k) all amendments in the NOC’s constitution has been made subject to comments from interested parties.
25) Chapter VII deals with the recognition of NSFs and others. It has enumerated in Section 10(1) that recognition would be granted on consideration like the legal statutes of the applicant, financial accountability, professional management, recognition by IOA for Olympic sports, status as an apex body and all India spread besides others.
26) Section 13 deals with the recognition of National/Regional Sports Promotional Organisation.
27) Section 14 deals with National Playing Field Association and seeks to register all playing fields that have been developed through Government assistance.
28) Till now the National Sports Policies served as mere guidelines. The Bill in Section 3 (1)(2) seeks to give efficacy to the National Sports Development Code of 2011 by stating that it has been notified under this Bill.
